This essay deals with the issue of the attribution of the surname to children, in the Italian legal system, in the light of the important and recent ruling of the Constitutional Court. Specifically, the latter affirmed the principle according to which the child takes the surname of both parents (and in the order agreed by the same) except in the case in which they decide, by mutual agreement, to attribute only the surname of one of two.
