An interlocutory injunction of the Court first civil section (n° 1842/2022) requested a new intervention of the united Sections on the topic of surrogacy, arguing that, in some circumstances, there is no contrast with the values underpinning the ban set forth by article 12 of the law n° 40/2004 (dignity of the pregnant woman and “preservation of the adoption institution”), and that, consequently, filiation relationship obtained through this practice can be recognized.
